Managing HMRC investigations

Investigation management covers both communication with HMRC and focusing on the key aspects which will determine how a case proceeds. We identify why HMRC are investigating and work together with our clients to establish a path to resolution. Our expertise on the use of HMRC’s powers helps our clients achieve the best possible outcomes. Effective communication with HMRC also influences how long an investigation will last, as well as the percentage penalties that HMRC will apply should additional taxes be due.


Making disclosures to HMRC

Tax is complex and it is possible to make mistakes. Where tax is underpaid as a result of these errors, HMRC can charge both late payment interest and significant tax penalties. There can also then be questions as to how HMRC will respond, and whether a full investigation of other years will follow. When errors are identified, it is important to find the best way to disclose these. Making the right approach, backed up by expert advice can help ensure that the process is handled as efficiently as possible. We help our clients navigate voluntary disclosures to HMRC, minimising penalties while ensuring accuracy and compliance.


Code of Practice 9 disclosures (COP 9)

Tax fraud is a crime which can lead to a criminal prosecution. When deliberate actions have resulted in an underpayment of tax specialist advice is needed both on correcting the position and on securing immunity against criminal prosecution by making a disclosure under Code of Practice 9 (COP9). Such high-risk cases are always sensitive and require timely action to ensure that the COP9 “Contractual Disclosure Facility” reporting requirements are met. We have helped many clients make COP9 disclosures, whereby a civil settlement is agreed with HMRC in return for a full disclosure and payment of the tax liabilities.


Appeals against HMRC decisions

We are often asked for a second opinion on whether an HMRC decision might be successfully appealed against. A dispute may have arisen about the interpretation of tax law, or tax planning may have been challenged by HMRC. In other cases, there HMRC may no longer accept the that the numbers returned by a business are reliable. In all appeals there are questions around process, timing, and who the burden of proof falls upon. We have successfully worked with clients and their legal teams to support formal appeals to the Tax Tribunal. In many cases negotiation with HMRC, or use of Alternative Dispute Resolution, might avoid the need for litigation. We advise our clients on the approach we think will obtain the best outcome and work to achieve this.


HMRC information requests

We advise clients in relation to HMRC information requests. Broadly, HMRC can request information or documentation that is reasonably required for the purposes of checking a tax position. Requests can be made directly to individuals and businesses, or to third parties or financial institutions. Managing these requests is key to successful tax dispute resolution. HMRC has extensive powers but the question of what information should be provided and how best to resolve any dispute often requires careful judgement.
